Online prices, selection and promotions generally match those offered outside of the website, including those via direct mail, email and fax, as well as those offered through shows and other sales channels, but may vary. Prices, selection, promotions and offers are subject to change.
SALES TAX POLICY

PAYING FOR YOUR ORDER
You may pay for your orders with PayPal™, or major credit cards issued in the United States of America. Currently, ASTRA SURGICAL accept Visa®, MasterCard®, American Express® and Discover® Card.
Generally, credit and debit cards are not charged until item(s) are shipped to you or availability is confirmed. ASTRA SURGICAL reserves to right to charge for orders partially fulfilled; you will be charged only for the goods ASTRA SURGICAL has actually shipped along with any appropriate taxes or shipping charges. However, ASTRA SURGICAL may pre-authorize your order amount with your credit or debit card issuer at the time you place the order, which may have an effect on your available credit line. When paying for a preorder with a debit card you will be charged at the time you place your preorder. Please contact your credit card issuer for more information.
ASTRASTARS™ REWARD PROGRAM
ASTRASTARS™ is a free program that lets you earn annual rebates to use on future purchases with ASTRA SURGICAL. Registered customers of Astrasurgical.com are automatically entered into the program and begin accumulating spend toward their rebates upon making their first purchase. Spend on the following may not accrue towards the annual spend amount used to calculate annual rebate rewards under the program: spend on previous purchases, prior to registration in ASTRASTARS™, purchases paid by reward certificates, sales taxes, state fees, shipping charges, restocking fees, or other excluded charges, along with certain items that are excluded in particular promotions. ORDER ACCEPTANCE/CONFIRMATION
After you place an order using ASTRA SURGICAL's shopping cart, ASTRA SURGICAL will check the information you give ASTRA SURGICAL for validity, by verifying your method of payment or shipping address.

RETURN POLICY

ASTRA SURGICAL may, at its own discretion, limit or cancel quantities purchased per person, per organization or per order. SHIPPING

You agree that ASTRA SURGICAL's remedy at law for any actual or threatened breach of this Agreement would be inadequate and that ASTRA SURGICAL shall be entitled to specific performance or injunctive relief, or both, in addition to any damages that ASTRA SURGICAL may be legally entitled to recover, together with reasonable expenses of any form of dispute resolution, including, without limitation, attorneys' fees.
No right or remedy of ours shall be exclusive of any other, whether at law or in equity, including without limitation damages injunctive relief, attorneys' fees and expenses.
No instance of waiver by ASTRA SURGICAL of ASTRA SURGICAL's rights or remedies under these terms and conditions shall imply any obligation to grant any similar, future or other waiver.
TERMINATION OF USE
ASTRA SURGICAL may, in its sole discretion, terminate your account or your use of the Site at any time. You are personally liable for any orders that you place or charges that you incur prior to termination. ASTRA SURGICAL reserves the right to change, suspend or discontinue all or any aspects of the Site at any time without prior notice.
In addition to any other legal or equitable remedies, ASTRA SURGICAL may, without prior notice to you, immediately terminate the Agreement or revoke any or all of your rights granted under this Agreement. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and ASTRA SURGICAL shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part. Any termination of this Agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination.
APPLICABLE LAW
This Site is created and controlled by ASTRA SURGICAL in the State of California, USA. As such, the laws of the State of California will govern these disclaimers, terms, and conditions, without giving effect to any principles of conflicts of laws.
SEVERABILITY
If any these provisions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed several and shall not affect the validity and enforceability of any remaining provision.
DISPUTES
Any dispute relating in any way to your visit to the Site or to the products you purchase through the Site shall be submitted to confidential arbitration in Chicago, California, except that to the extent you have in any manner violated or threatened to violate ASTRA SURGICAL's intellectual property rights, ASTRA SURGICAL may seek injunctive or other appropriate relief in any state or federal court in the State of California. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, related to or connected with the use of the Site or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever banned.
